In this video we talk about how anyone can file a case or complaint with consumer forum in India without any need of a lawyer?
Some important things that you should know are as follows:
1. Consumers can lodge their grievance with Consumer Protection Councils which are setup at Centre (National Consumer Disputes Redressal Commission), State (State Consumer Disputes Redressal Commission) and District (District Consumer Disputes Redressal Forum) levels.
2. You can make a consumer complaint when:
* As a consumer you suffer Loss or damage due to unfair or restrictive trade practice of a trader or service provider.
* You use Goods and services which are hazardous to life and safety, when used, and are currently being offered for sale to the public.
* You purchase a defective item or you suffer from a service deficiency.
* A trader or service provider charges you for a good or service in excess (higher than MRP).
* and more...
3. A consumer or a group of consumers (who have purchased same goods/services and are currently suffering) can lodge a complaint with consumer forum.
In case of death of a consumer, his legal heir or representative can also file a complaint.
4. As per the Consumer Protection Act, 1986:
* If the value of your claim is up to 20 lakh, then you need to go to District Consumer Disputes Redressal Forum (DCDRF).
* If the value of your claim is more than 20 lakhs but less than 1 crore, then you need to go to State Consumer Disputes Redressal Commission (SCDRC).
* If the value of your claim is more than 1 crore, then you need to go to National Consumer Disputes Redressal Commission (NCDRC).
5. In case you are not satisfied with the order of NCDRC, then you can appeal at Supreme Court.
6. You are required to pay certain fee (depending on the value of your claim and) to the commission (except if you hold a Antyodaya Anna Yojana Card).
7. For filing your complaint:
* Make use of a plain paper. There is no need to use a stamp paper.
* Your complaint should contain the details of the complainant and the opposite party.
* You can file your complaint with the commission in person OR through your authorized representative OR by post.
* Attach all necessary proofs/receipts/other relevant documents with your complaint.
8. After purchasing a good or service you can file a grievance against the deficiency within 2 years from the date of purchase. Under special cases, you can lodge your complaint even after 2 years provided that you convince the forum/commission regarding why you can't file a complaint within 2 years from the date of purchase?
9. If you are not satisfied by the order of District forum then you can file a appeal petition before the State Commission within 30 days from the date of receipt of Order. After 30 days you won't be able to file an appeal in any case.
10. If you are not satisfied by the order of State Commission then you can file a appeal petition before the National Commission within 30 days from the date of receipt of Order. After 30 days you won't be able to file an appeal in any case.
11. If you are not satisfied by the order of National Commission then you can file a appeal petition before the Supreme Court within 30 days from the date of receipt of Order. After 30 days you won't be able to file an appeal in any case.
